This is the agreement between you and Others Studio about Murmur. It is in closed beta right now — the software will change, it can break, it may stop. What follows sets out what we promise, what we don't, how the money works, and what happens when something goes wrong. Where your data goes is not on this page; it's on Where your data lives, written up in more detail than here.
Murmur is a dictation tool for macOS: you hold a hotkey, you speak, and the words land at your cursor. It is made by Others Studio (ABN pending), operating from Victoria, Australia. Downloading or installing Murmur, or signing in inside the app, means you accept these terms.
Things will change. The interface, the engine list, the allowances and the price are all still moving. We give notice where we can, but we don't promise that any feature stays forever.
There will be bugs. We use it ourselves every day; that is not the same as it having no defects. Tell us when you hit one.
It may stop. If we shut the project down, we tell you in advance and refund the part you have paid for and not used.
Cloud allowance is invite-only. Downloading the app and running on-device recognition need no account; using cloud allowance needs a beta seat.
One person, one account, registered with your own email address. Don't lend it to anyone — allowance is counted per account, so lending the account means lending your own allowance. If we find an account farming allowance with scripts, or being used for something illegal, we shut that account down.
The free tier includes 2,000 words a week of cloud dictation and cleanup, plus 30 minutes a month of long-form recording. These are cloud bills we pay on your behalf, not something you bought — so the exact numbers may be adjusted, and we say so in the app or on this site before they are. Running out does not cut you off: it falls back to on-device recognition, which is slower and weaker on mixed-language speech, but your words are not lost.
Nothing is charged right now. Paid subscriptions are not open during the beta and there is no checkout on the site — you will not be billed. This section takes effect when we start charging, and it will be updated here first.
Your recordings, transcripts, history and dictionary all stay on your own Mac; our servers only handle accounts and subscriptions. Choose cloud recognition and the audio goes straight to that recognition service; choose on-device recognition and not one byte leaves this computer. The full routing, retention periods and deletion steps are written up in Where your data lives. What you say is yours — we don't train any model on it, and we don't sell it to anyone.
Recognition and cleanup are the two steps that use third-party providers. Whichever tier you pick decides where your audio goes; that part of the processing is bound by that provider's own terms and is outside our control. You can also enter your own API key and connect directly (which doesn't pass through our servers at all). Payment is handled by Stripe — we never see or store your card number.
Recognition is not guaranteed to be accurate. Speech recognition always gets things wrong — accents, background noise, proper nouns and homophones all push it off. Murmur does its best and promises no accuracy figure at all.
So: don't put it where a mistake is expensive — medical records, legal documents, financial instructions, contract terms. In that kind of work, have a person check it word by word before it counts. Every line it drops at your cursor deserves one look from you before it goes anywhere.
No promise of uninterrupted service. The third-party services it depends on, your network, and our servers can all fail. When the network drops or the allowance runs out it falls back to on-device recognition — which is not failure-proof either.
To the fullest extent the law allows, we are not liable for indirect loss arising from your use of Murmur (missed business, lost data, damage to reputation); where we do owe you something, the total is capped at what you actually paid us in the preceding 12 months.
Once more: the paragraph above neither excludes nor limits the mandatory rights the law gives you where you live — the consumer guarantees of the Australian Consumer Law, EU and UK consumer rights, and equivalent rules in other jurisdictions. Wherever the law does not permit liability to be excluded, these limits do not apply.
Murmur is sold to people all over the world, and we are in Australia. A few things are worth saying up front:
Prices are in Australian dollars (AUD). Your bank or card issuer may convert at its own rate and add a cross-border fee — that part isn't collected by us, and we can't refund it either.
Tax. If the law where you are requires us to collect VAT or GST, the checkout lists it before you pay.
Your local consumer rights come first. See sections 5 and 9 above — mandatory rights are never excluded by these terms.
Reachability. In some countries the network conditions may stop the download, the sign-in or the payment from going through. That isn't your account being broken; write to us and we'll see whether there's another way.
They get updated. Changes are dated on this page, and the ones that matter are announced in the app. Carrying on using Murmur means accepting the new version.
Governing law is the law of Victoria, Australia, and disputes go to that state's courts — but this does not deprive you of the mandatory consumer protections you have as a resident of your own country, which no contract can exclude.
If one clause fails, the rest stay in force.
